1. Agreement to these terms
These Terms of Use (“Terms”) apply to your use of spaces4healing.com (“the Site”), operated by the D.A.Y. Foundation (“the Foundation,” “we,” “us,” or “our”). By using the Site, requesting support, or making a donation, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. What the Site is for
The Site provides information about the Foundation and its programs, lets you request support or a referral, and lets you make a donation. Program descriptions explain what we offer or are working to offer; availability, eligibility, and locations can change, and a description on the Site is not a promise that a particular service is available to you.
3. Not emergency or medical services
The Site is not for emergencies. If you or someone else is in danger or needs urgent medical care, call 911 or your local emergency service immediately. If you are in crisis, you can call or text 988 to reach the Suicide and Crisis Lifeline; veterans can press 1 after dialling 988 to reach the Veterans Crisis Line.
Information on the Site is general and is not medical, dental, legal, financial, or benefits advice. It does not replace advice from a qualified professional about your own situation. Using the Site or submitting a request does not create a provider and patient relationship, an attorney and client relationship, or any other professional relationship.
4. Requesting support
When you submit a support request, you agree that the information you give us is accurate and that it is yours to share. A coordinator will review it and contact you using the details you provide.
Submitting a request does not guarantee that we can provide a service, that you will be eligible for a program, or that a partner organization will accept a referral. Where we cannot help directly, we will try to point you toward someone who can.
Please do not include medical records, diagnoses, Social Security numbers, or other sensitive information in the form. See our Privacy Policy for how we handle what you send.
5. Donations
Processing
Donations are processed by Stripe, Inc. You enter your payment details on Stripe’s secure payment page, and your payment is also subject to Stripe’s terms. The Foundation never receives or stores your card number. Stripe will email a receipt to the address you provide.
Directing your gift
You may ask for your gift to support a particular program. We honour that request wherever we can. If a program is fully funded, changes, or cannot use the gift as intended, the Foundation may apply it where the need is greatest in keeping with our mission.
Refunds
Donations are voluntary and generally final. If a gift was made in error, for the wrong amount, or without your authorization, contact us at info@spaces4healing.com within 30 days of the date of the gift, and we will work with you to correct it. Refunds are returned to the original payment method.
Tax treatment
Whether a donation is tax deductible depends on the Foundation’s tax status and on your own circumstances. Please keep your receipt and consult a tax advisor about how your gift may be treated.
6. Acceptable use
You agree not to:
- use the Site for any unlawful purpose or in breach of these Terms;
- submit false information, or information about another person without their permission;
- attempt to gain unauthorized access to the Site, its administration area, or its systems;
- interfere with the Site’s operation, including by introducing malicious code or overloading it;
- use automated tools to scrape, copy, or collect information from the Site; or
- use the donation form to test stolen or unauthorized payment cards.
We may restrict or refuse access to anyone who does.
7. Our content
The text, design, logos, images, and other material on the Site belong to the Foundation or are used with permission, and are protected by copyright and trademark law. You may view, print, and share pages for personal and non commercial purposes, provided you do not alter them and you credit the Foundation. Any other use requires our written permission.
8. Links and third party services
The Site may link to websites and services we do not control, including Stripe and partner organizations. We are not responsible for their content, policies, or practices, and a link is not an endorsement. Your use of them is governed by their own terms.
9. Disclaimers
We work to keep the Site accurate and available, but it is provided “as is” and “as available.” To the fullest extent permitted by law, we make no warranties, express or implied, that the Site will be uninterrupted, error free, or free of harmful components, or that information on it is complete or current.
10. Limitation of liability
To the fullest extent permitted by law, the Foundation, its directors, staff, volunteers, and partners will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Site, or from your reliance on information on it. Nothing in these Terms limits liability that cannot be limited by law.
11. Your responsibility
You agree to indemnify the Foundation against claims, losses, and expenses arising from your breach of these Terms or your misuse of the Site.
12. Changes to these terms
We may update these Terms from time to time. The date at the top of this page shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the state in which the D.A.Y. Foundation is organized, without regard to its conflict of law rules. If any part of these Terms is found unenforceable, the rest remains in effect.
